Application to be forwarded to the Patent Office

If your company wants to register a Trademark in 2-3 countries, the most favorable option would be to apply through patent attorneys directly to the Patent Offices in these countries. For example, filing of application in Uzbekistan, Tajikistan and Kazakhstan is cheaper and faster than filing of application through the Madrid System. If your company wants to register a Trademark, for example, in all countries of the European Union the best option would be the registration through the Madrid System which allows considerably reduce the cost and simplify and accelerate the trademark registration. The System excludes postal charges, translation of the application documents into several languages, and payment of fees to the patent attorneys registered in these countries. Also, a period of national registration of a trademark lasts longer and takes over three years, for example in Germany.

The International registration under the Madrid System

This is the registration of trademarks already registered in your country in others 81 countries/participants of the Madrid Agreement on the International Registration of Trademarks and the Madrid Protocol by filing an application to the International Bureau of WIPO Geneva through the national department (the Kyrgyz Intellectual Property Office) with one application and payment of a single one-time fee for all the applied countries.

The International registration of trademarks suggests a simplified filing of application for trademark registration without participation of patent attorneys in these countries and with no payment of the fixed fee in each country (except for some countries where some individual fees are to be paid, for example in Australia, Norway, the USA, Ukraine, Uzbekistan and some others).

Application for the International registration of trademarks demands compulsory basic registration of a trademark in your country.

Fees for the international registration of a trademark are estimated as follows:

** – For some countries of the Protocol the individual fees are paid depending on the number of classes of commodities and services to register a trademark; the fees are estimated separately for each case. For example: individual fee for the Kyrgyz Republic is 340 CHF.

В соответствии с нормой предусмотренной в Правилах составления, подачи и рассмотрения заявки на регистрацию товарного знака и знака обслуживания, «по ходатайству заявителя и при условии уплаты установленной пошлины экспертиза заявленного обозначения (товарного знака) может быть проведена досрочно, до истечения двенадцати месяцев».

Срок регистрации по ускоренной процедуре составляет около 7-9 месяцев (точный срок Законом не предусмотрен). Срок регистрации уменьшается в двое, но и стоимость увеличивается почти в два раза.

За проведение досрочной регистрации товарного знака предусмотрена дополнительная пошлина – 10 тыс. сомов (около 147 USD).

Обычно мы не рекомендуем использовать ускоренную регистрацию товарного знака и применяем ее только в исключительных случаях, например, в случае уже использования Вами товарного знака и необходимости пресечения недобросовестной конкуренции. В других же случаях достаточно даты приоритета подачи заявки, после которой всем другим заявителям, помимо Вас, со схожим товарным знаком (обозначением) будет отказано в регистрации (п.1 ч.1 ст.5 Закона КР “О товарных знаках…”).

According to the standard as provided by the Rules of compilation, submission and consideration of application for registration of trademark and service mark, “on request of the applicant and under condition of payment of the established fee, the examination of the applied trademark can be conducted ahead of schedule, prior to expiry of twelve months”.

Period of registration under the accelerated procedure takes about 7-9 months (exact period is not provided by the law).Period of registration reduces in half, and the cost increases almost twice.

Pre-schedule trademark registration demands extra fee as provided by the Kyrgyz Intellectual Property Office — about 147 USD.

Usually, we do not recommend using the accelerated trademark registration and we only apply it in exceptional cases, for example, in case if the trademark is being used by you and any unfair competition must be restrained. In other cases, it is enough to set the priority date of the application after which all other applicants with a similar trademark, besides you, will be rejected (clause 1, part 1, item 5 of the Law of Kyrgyz Republic “Law on Trademarks…”).

Registration of a trademark (service mark) is an act to state the protected mark and the volume of its protection including colors and the list of wares and services. A governmental body to fulfill functions in the field of protection and registration of trademarks (service marks) in Kyrgyzstan is the Kyrgyz Intellectual Property Office. According to paragraph 3, article 3 of the Law of Kyrgyz Republic “Law on Trademarks…” “The holder of a trademark shall have the exclusive right to use and dispose of the trademark, and to forbid its use by other entities and individuals. No entity or individual in Kyrgyz Republic can use a trademark without permission of its holder”.

Steps for the trademark registration

Preliminary search

Before filing an application for a trademark registration, we strongly recommend you our service of Preliminary search which consists of two steps: (i) Establishing a possibility of registration of a mark as a trademark and (ii) Checking of the mark in the registered trademarks database.

i. Establishing of possibility of registration of a mark as a trademark is a kind of service we provide to our clients free of charge. The matter is that there are lots of restrictions towards the things which cannot be registered as trademarks and as to how to register a mark to have it as “strong” as possible. For example, the marks which do not possess any distinctive ability (certain letters, abbreviations, technical signs, etc.), and do not specify the kind, quality, quantity, properties, destination, value of products, and time and place of their origin, manufacture or sale cannot be registered. At this step, some 10% of marks are screened, and 30% of them are to be modified and completed (“amplified”).

ii. Checking of a mark in the registered trademarks database is a necessary step since it saves essential money for our clients-principals. The check costs much cheaper than the trademark registration and at this step already some 35% of marks are screened as it shows that the same or similar marks which can prevent the principal’s trademark registration had already been registered. Cost of the check depends on what mark is being checked – verbal, graphic or combined.

Preliminary examination

Period of preliminary examination is 14 days. At this step the Kyrgyz Intellectual Property Office validates the correctness of application and completeness of documents (reproduction of the mark, power of attorney, fee payment receipt, etc.).

Examination of the alleged mark

Period of examination of the alleged mark is 7 months from the date of application. At this step the Kyrgyz Intellectual Property Office carries out:

• Checking of conformity of the application materials to the requirements on contents and registration of the application;
• Checking of the list of products and services and correctness of their grouping as per the ICGS;
• Establishing a priority of the trademark;
• Checking of conformity of the alleged mark to the registration conditions as set put in articles 9 – 10 of the Law of Kyrgyz Republic “Law on Trademarks”.

Fees for registration, publication and delivery of the Certificate

Upon making a positive decision on the trademark registration the applicant is given 3 months for payment of fee for the trademark registration, publication and delivery of the certificate.

Registration, publication and delivery of the Certificate

The exclusive right to the trademark begins on the date of publication of data on the trademark registration in the Kyrgyz State Register of Trademarks and in the official bulletin Intellektualdyk Menchik published by the Kyrgyz Intellectual Property Office. From this day only the legal holder of the trademark shall have the right to forbid using of the trademark by the third parties.
