Copyright to software and database does not require their registration; their statement in the objective form would be enough. Registration of copyright is voluntary and can be conducted by the right-holder within the entire period of copyright validity.
Legal value of registration of software and database is the acknowledgement of the Kyrgyz Intellectual Property Office that the data contained in the state register are true as of a certain date, and the copyright and property rights belong to the persons specified in the certificate. And the applicant is liable for reliability of the data submitted for registration.
The right to apply for registration is given to the right-holder of all property rights to the software or database directly or through the agent (PravUM).
The application for official registration of software or database should refer to one software program or one database.
Period of registration of software or database program:
The application is considered within 6 (six) months from the date of submission; however this period can be extended due to inquiries made by the Kyrgyz Intellectual Property Office. The Certificate is delivered within some two months. Total 6-8 months.
The application for registration of software or database shall contain:
- The application for official registration of software or database with indication of the right-holder and the author if he has agreed to be mentioned as the author, and their location (residence);
- The deposited materials to identify the software or database, including the abridgement,
- A document to confirm the payment of the registration fee in the established amount or a basis for release from payment of the fee, and for its reduction.
Fees to be paid to the Kyrgyz Intellectual Property Office for registration of software and database:
- For private individuals and noncommercial entities – $9 USD;
- For the World War veterans and disabled persons (disability status 1) – released from the fee;
- For legal entities – $90 USD.
